Development and prerelease terms
These Terms govern the Aura website and any development, preview, beta, or prerelease version of the Aura mobile application made available to you. By accessing or using Aura, you agree to these Terms.
Introduction
These Terms of Use (“Terms”) govern your access to and use of the Aura website, including downloadaura.app and its associated pages, as well as any development, preview, beta, or prerelease version of the Aura mobile application that Aura App LLC makes available to you. The website and application are operated by Aura App LLC (“Aura,” “we,” “us,” or “our”). By accessing or using the Aura website or any version of the Aura application made available to you, you agree to these Terms. If you do not agree, do not use the website or application.
1. About Aura
Aura is an iOS application under active development. Aura is intended to help adults build habits, complete focus sessions, track progress, and reduce distracting phone use. The current website may contain information about features that are being developed, tested, changed, delayed, or removed before public release. Descriptions of planned functionality are provided for general informational purposes and are not promises that a feature will be released by a particular date or released at all.
2. Age Requirement
You must be at least 18 years old to use Aura. By accessing the website or using the application, you represent that you are at least 18 years old and legally capable of agreeing to these Terms. Aura is not intended for children or individuals under 18.
3. Development and Prerelease Status
Aura is currently under active development. Development, preview, beta, and prerelease versions may contain errors or incomplete features, operate differently from the final version, lose or reset locally stored data, become unavailable without notice, produce inaccurate results, change substantially before release, include test interfaces or simulated information, or fail to operate as intended. You should not rely on a development version of Aura for critical, emergency, medical, safety, financial, legal, employment, educational, or other high-risk decisions. We may add, modify, suspend, restrict, replace, or remove any feature at any time.
4. Limited Permission to Use the Website
Subject to these Terms, Aura App LLC grants you a limited, personal, revocable, non-exclusive, non-transferable permission to access and use the website for lawful, noncommercial purposes. This permission does not transfer ownership of the website, application, source code, designs, trademarks, written materials, images, or other Aura property to you.
5. Acceptable Use
You agree not to use the website or application for unlawful, fraudulent, abusive, or harmful purposes; attempt to gain unauthorized access to Aura’s systems, servers, accounts, source code, or infrastructure; probe, scan, or test the vulnerability of Aura’s systems without written authorization; interfere with the operation or security of the website or application; introduce malware, malicious code, automated attacks, or harmful content; scrape, crawl, copy, or systematically extract website content without permission; reverse engineer, decompile, disassemble, or attempt to derive the source code of the application, except where applicable law expressly permits it; bypass technical restrictions or security measures; impersonate another person, company, or organization; misrepresent your connection to Aura App LLC; use Aura to violate another person’s privacy, intellectual property, or other legal rights; submit photos or content that you do not have the right to use; use Aura to harass, threaten, exploit, stalk, or harm another person; use Aura to develop, train, test, or improve a competing product without our written permission; or use automated systems to create excessive traffic or burden Aura’s infrastructure. We may restrict or terminate access when we reasonably believe these Terms have been violated.
6. AI Habit Verification
Development versions of Aura may include an AI-assisted habit photo verification feature. When you choose to use this feature, a photo and related habit information may be sent to third-party AI and infrastructure providers for analysis, as explained in the Aura Privacy Policy. AI verification results may be incomplete, inaccurate, inconsistent, or incorrect. A passed or failed verification result does not establish that a habit was actually completed, that a statement is true, or that a person complied with any legal, medical, professional, educational, or contractual requirement. You remain responsible for deciding whether to use AI verification, reviewing the verification result, ensuring that submitted content is lawful, ensuring that you have permission to submit the photo and related information, and avoiding sensitive, confidential, or identifying information in submitted content. You must not submit photos of children, photos of other individuals without appropriate permission, government identification documents, passwords or authentication credentials, financial account details, medical records, confidential business information, or illegal, exploitative, or abusive content. Aura does not guarantee the accuracy, reliability, availability, or suitability of AI-generated results.
7. No Medical or Professional Advice
Aura is a habit-building and productivity tool. It is not a healthcare provider, medical device, mental health service, therapist, doctor, emergency service, or substitute for professional advice. Information presented by Aura is for general informational and motivational purposes only. Aura does not provide medical advice, mental health diagnosis or treatment, emergency assistance, legal advice, financial advice, nutritional or fitness prescriptions, or professional counseling. Do not disregard professional advice or delay seeking help because of information displayed by Aura. If you believe you are experiencing a medical or mental health emergency, contact local emergency services or an appropriate qualified professional.
8. Screen Time and Focus Features
Aura does not currently offer a completed production Screen Time or app-blocking system. Development versions may include test interfaces, simulated information, or permission-request flows related to Apple’s Screen Time or FamilyControls technologies. You should not depend on Aura to prevent access to another application, enforce a focus schedule, supervise another person, or provide parental controls. Even after these features are developed, software restrictions may fail, be bypassed, become unavailable, or behave differently because of operating-system changes, device settings, emergency overrides, technical errors, or permission changes. You remain responsible for your device use and focus decisions.
9. Notifications
Aura’s notification functionality is currently under development. Notification-related interfaces or settings shown in a development version may not be fully operational. Aura does not guarantee that a reminder will be scheduled, delivered, displayed, or delivered at a particular time. You should not rely on Aura notifications for medication, medical appointments, emergencies, legal deadlines, financial deadlines, safety procedures, or other time-critical obligations.
10. Accounts
Aura does not currently provide a completed user-account or authentication system. Entering a name or email address into a development version of the application does not necessarily create an online Aura account. If account registration, authentication, or cloud synchronization is introduced, these Terms and the Aura Privacy Policy will be updated as appropriate before that functionality is released.
11. Payments and Subscriptions
Aura does not currently offer an active paid subscription or completed in-app purchase system. References to premium functionality, subscription plans, trials, prices, or payment interfaces in development materials do not constitute a current offer to sell unless an actual purchase flow has been activated through the Apple App Store. Before paid subscriptions or purchases are offered, Aura will provide applicable pricing, renewal, cancellation, trial, and billing information and update these Terms as appropriate.
12. Referrals and Sharing
Aura may allow you to prepare or share a referral link through the standard iOS share sheet. You choose whether to share referral content and which third-party application or service receives it. You may not send misleading or deceptive referral messages, send unsolicited bulk messages, use automated referral distribution, represent yourself as an employee or official representative of Aura, promise rewards, discounts, payments, or benefits not expressly authorized by Aura, or use referral links in violation of another platform’s terms. We may modify, suspend, or end a referral program at any time. Unless we expressly state otherwise in writing, referral activity does not guarantee compensation, discounts, credits, or other rewards.
13. Feedback
You may voluntarily send us ideas, suggestions, feature requests, bug reports, comments, or other feedback. You retain ownership of original material contained in your feedback. However, by submitting feedback, you grant Aura App LLC a worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, distribute, display, commercialize, and incorporate that feedback into Aura or other products without compensation or attribution to you. Do not submit feedback containing confidential information that you do not want us to use.
14. Intellectual Property
The Aura website, application, branding, designs, logos, graphics, text, interfaces, software, code, features, and other materials are owned by Aura App LLC or its licensors and are protected by applicable intellectual property laws. “Aura,” associated logos, and related branding may not be used without prior written permission from Aura App LLC. Nothing in these Terms grants you permission to use Aura’s trademarks, branding, copyrighted material, source code, or other proprietary property except for the limited use expressly allowed by these Terms.
15. User Content
You retain ownership of content you create or submit through Aura. You represent that you own the content or have the necessary rights to submit it, your submission does not violate applicable law, your submission does not violate another person’s privacy or intellectual property rights, and your submission is not fraudulent, abusive, exploitative, or harmful. You grant Aura App LLC and its service providers a limited license to process submitted content only as reasonably necessary to operate, secure, test, troubleshoot, and provide the requested feature. The handling of personal information is further described in the Aura Privacy Policy.
16. Privacy
Our handling of personal information is described in the Aura Privacy Policy available at: https://downloadaura.app/privacy. By using Aura, you acknowledge that you have reviewed the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
17. Third-Party Services
Aura may interact with or link to third-party services, including AI service providers, hosting and infrastructure providers, Apple services and frameworks, email providers, external help or feedback services, and social or messaging applications selected by the user. Third-party services are not controlled by Aura App LLC. Their own terms, privacy policies, availability, and security practices apply. We are not responsible for third-party websites, applications, content, services, outages, decisions, or data-handling practices. Your use of third-party services must comply with any terms that apply to those services.
18. Website Links
The Aura website may contain links to websites operated by third parties. A link does not mean Aura App LLC endorses, controls, guarantees, or accepts responsibility for that website or its content. You access third-party websites at your own discretion and risk.
19. Availability and Changes
We do not guarantee that the website or application will always be available, error-free, secure, compatible with every device, compatible with every version of iOS, complete, accurate, or uninterrupted. We may perform maintenance, change providers, discontinue features, limit access, or take the website or application offline without prior notice. We are not responsible for loss caused by service interruptions, device failure, operating-system updates, third-party failures, data loss, or changes to prerelease functionality.
20. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the website, application, AI results, content, and services are provided “as is” and “as available.” Aura App LLC disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, security, non-infringement, and quiet enjoyment. We do not warrant that Aura will meet your requirements, produce a particular result, improve your habits, reduce your screen time, maintain a streak, prevent access to another app, or operate without interruption or error. Some jurisdictions do not allow certain warranty disclaimers. In those jurisdictions, the disclaimers apply only to the maximum extent permitted by law.
21. Limitation of Liability
To the maximum extent permitted by applicable law, Aura App LLC and its owners, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of or inability to use Aura, loss of data, loss of profits or business opportunities, device problems, missed reminders, failed focus or blocking features, AI verification errors, third-party services, unauthorized access, or reliance on development-stage functionality. To the maximum extent permitted by law, the total aggregate liability of Aura App LLC for claims arising from or relating to the website, application, or these Terms will not exceed the greater of the amount you paid directly to Aura App LLC during the 12 months before the event giving rise to the claim, or one hundred U.S. dollars. These limitations do not apply where applicable law does not permit them.
22. Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Aura App LLC and its owners, officers, employees, contractors, affiliates, licensors, and service providers from claims, damages, obligations, losses, liabilities, costs, and expenses arising from your unlawful or unauthorized use of Aura, your violation of these Terms, content you submit, your violation of another person’s rights, or your misuse of referral or sharing features. This section does not require you to indemnify Aura App LLC for conduct for which indemnification cannot legally be required.
23. Suspension and Termination
We may suspend, restrict, or terminate access to the website, application, development builds, or specific features if you violate these Terms, your use creates a security or legal risk, your use harms Aura, another user, or a third party, we are required to do so by law, a service is discontinued, or a development or beta program ends. You may stop using Aura at any time. Sections that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, feedback, disclaimers, liability, indemnification, and disputes.
24. Governing Law
These Terms are governed by applicable United States law and, where applicable, the laws of the state in which Aura App LLC is legally organized, without regard to conflict-of-law principles. Any dispute will be brought in a court of competent jurisdiction, unless applicable consumer law gives you the right to bring a claim elsewhere. Nothing in these Terms removes consumer rights that cannot legally be waived.
25. Changes to These Terms
Aura is under active development, so these Terms may change as the website, application, business model, and available features change. When we update these Terms, we will revise the effective date at the top of this page. Material changes may also be communicated through the website, application, or another reasonable method. Your continued use after updated Terms take effect constitutes acceptance of the updated Terms to the extent permitted by law.
26. Entire Agreement
These Terms and the Aura Privacy Policy constitute the agreement between you and Aura App LLC concerning the current website and any Aura development version covered by these Terms. If a provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision does not waive our right to enforce it later. You may not transfer your rights or obligations under these Terms without our written consent. Aura App LLC may transfer these Terms in connection with a merger, acquisition, reorganization, sale of assets, or operation of law.
